The jury deciding the fate of Keith Phoenix, who stands charged with second degree murder as a hate crime in the beating death of Ecuadorian immigrant Jose Sucuzhanay, is deadlocked.

The Jury foreperson delivered a note to Judge Patricia Di Mango just after 7 p.m. “Your Honor, we are at an impasse over a single count,” the note said  “What should we do?”

Judge Di Mango called the jury back into the courtroom and implored them to listen to each other and work together to come to a unanimous verdict. “Each of you have made a commitment that requires you to deliberate together,” Di Mango said. “I urge that each of you make every possible effort to arrive at a just verdict.”

Di Mango returned the jury to deliberate further at 8:20 p.m. There is no information whether the jury has reached a conclusion on other counts.
