State district court judge for Brooklyn Johnny Lee Baynes issued his second temporary restraining order today to halt any move by SUNY Downstate Medical Center to close Long Island College Hospital. A hearing is scheduled for May 2 where Baynes will consider whether or not SUNY Downstate’s second decision on March 19 to close LICH was made illegally. Four days before, Baynes had vacated SUNY Downstate’s initial decision to close LICH. In that first decision, he agreed with LICH’s supporters who argued that that the February board meeting where the decision was made was held improperly and violated the New York state Open Meetings law.
