Dr. Michael Greenberg of the Office of the Medical Examiner, New York City, testified about the autopsy performed on Jose Sucuzhanay. According to Dr. Greenberg, Jose Sucuzhanay suffered multiple skull fractures, which led to brain injury. Jose Sucuzhanay was pronounced brain dead in Elmhurst Hospital on December 8, 2008 and the autopsy was performed on Dec. 13, 2008.
Dr. Greenberg also testified that Sucuzhanay died from injuries caused by a heavy object, consistent with being struck with a baseball bat. When questioned as to whether being hit with a bottle killed Sucuzhanay, Dr. Greenberg testified no.
