Two witnesses testified for the prosecution as the murder trial for Keith Phoenix and Hakim Scott resumed after a long weekend break.

Kuson Nelson, a resident of Bushwick Avenue, testified that he was returning home the night of the incident and saw part of the altercation where Jose Sucuzhanay was killed Dec. 7, 2008. Nelson testified that he  saw Jose and Romel Sucuzhanay walking “hugging and just playing around” when the driver of a burgundy SUV yelled, “look at those faggot motherfuckers!” Nelson said that he saw an African-American man exit the car and swing a bottle. He testified that he heard the bottle break, but did not see it crash on anything.

Nelson also said that he saw a second African-American man take out a baseball bat and swing it twice. While he could not see the bat strike anything, he said that he heard a sound “like bat hitting bone.”

Lawyers then questioned Detective Charles Reiss of the crime scene unit who removed a section of carpet from the back of Keith Phoenix’s SUV when it tested positive for traces of blood.

The Brooklyn Ink is in court every day following the trial of Keith Phoenix and Hakim Scott who are charged with the hate-crime murder of Jose Sucuzhanay.
