The lawyers for Michael Mineo, the man that said police sodomized him after they caught him smoking pot outside Prospect Park, said the police may have  tampered with his underwear before trial. The police were acquitted in a criminal trial, but now, two weeks before a $440 million civil trial, Mineo’s lawyers are saying that the Internal Affairs Bureau cut the underwear. Mineo said police had used a baton to sodomize him while they tried to subdue him after he fled from the park to a nearby subway terminal in October. “Police officers initially investigating the Oct. 15, 2008 incident cut out material on Mr. Mineo’s underwear to make it appear as if the hole that resulted from the ASP puncturing through his underwear during the assault was shaped as a square,” attorney Stephen Jackson claims. “They accuse him of making the hole,” Mineo’s attorney, Stephen Jackson said.
